Here you find the conditions that apply to the making of portraits (this in connection with the uniqueness of the portraits) and when you buy something in the webshop:

Starting the assignment and waiting list
I work on portraits/painting commissions in order of application requests. When you apply, you will be put on a waiting list – if applicable. As soon as I know when I can start working on your project, you will be notified in a timely manner. The length of the waiting list can sometimes vary greatly – in recent months – so please inquire.

If I want to start on your project and I haven’t received any photo material or other (necessary) information yet, I will move on to the next one on the list. This is to avoid waiting times for others.

I do drawing and painting as a hobby in addition to my work as a full time consultant/designer at my own company. I therefore do not work with deadlines and cannot provide promises to when a work will be finished.
Deposit and refund
The moment I start your project, I ask a down payment of 50% of the total price (shipping excluded), for which you will receive an invoice. This invoice has to be paid within the set payment period of 30 days.

If afterwards you are not satisfied with what I have made, I keep this down payment as a minimum coverage of the hours and material costs made. You do not have to pay the second installment (50%) of the price. The work I made then remains my property and I may sell it to a third/other interested party. There can never be a refund.

Reverse VAT
If you have a company in Europe, outside Spain, and you have a VAT number registered in the VIES database, you can request to reverse the VAT in the invoice from AtelierBrigitte.

To do this, it is necessary to provide all the (tax) data of the company as registered in the VIES database.

AtelierBrigitte reserves the right to suspend the reverse charge of VAT if the information turns out to be incorrect. Regular VAT will be applied on the invoice.

Image requirements
To achieve the best result, it is important that I have access to good photo/image material. I reserve the right to reject any projects if good photo/image material is not provided.
Cost and risk of shipment
The cost of shipping the work, including a fee for packaging materials, are paid by the client. The risk of shipping the work lies with the client. I make every effort to pack the work as well and securely as possible to prevent damage during shipment. I ship the work only after the second installment (plus shipping costs) has been received by me.

Preservation or rights
AtelierBrigitte retains at all times all rights of the work created and may therefore publish and use, under my own name and/or under AtelierBrigitte or Pica2, for all purposes anywhere (Internet, printed matter, postcards, posters – this enumeration is not exhaustive). The work created by me is for the client’s personal use only, unless otherwise agreed in advance.

This part of the conditions applies additionally for consumers (individuals) who buy something in the webshop of AtelierBrigitte.

  • If there is an offer (promotion) with a limited validity period or applicable under certain conditions, this will be explicitly stated with the offer.
  • Due to the uniqueness of most of the products in the webshop, it is possible that an item has already been sold. In that case, AtelierBrigitte will contact the consumer to come to an alternative.
  • The consumer can cancel the purchase without giving any reason within 14 days. This period starts the day after receiving the product by the buyer. The consumer must return the product in its original condition and packaging. The buyer is responsible for paying the shipping costs for returning the item. Shipping costs are non-refundable. Refund of the purchase amount takes place within 14 days after receipt of the returned product by AtelierBrigitte. You will be notified when the product has been received.
  • The previous article does not apply to commissions or custom (animal) portraits. This due to the personal nature of the product.
  • Additional non-returnable items: gift cards and downloadable items.
  • In case of complaints regarding the webshop, an e-mail can be sent to info@atelierbrigitte.nl. When reporting a complaint, the consumer should clearly indicate the product, purchase date and description of the complaint.
By giving an assignment or request to me, you agree to the terms and conditions mentioned and described.
